Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the website www.trimarkrealty.com (the “Site”), including our home search, property listing, saved search, saved listing, listing alert, account, communication, advertising, marketing, and related online services.

The Site is owned and operated by Trimark Realty and Trimark Investment Corporation dba Trimark Realty (“Trimark Realty,” “Company,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, saving a property, creating a saved search, signing up for listing alerts, submitting a form, clicking an advertisement, contacting us, or otherwise using any part of the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

1. Eligibility and Use of the Site

The Site is intended for individuals who are at least 18 years old and located in the United States. By using the Site, you represent and warrant that you are of legal age to form a binding contract and that you will use the Site only for lawful purposes and in accordance with these Terms.

You agree to use the Site only for your personal, non-commercial real estate search, evaluation, communication, and transaction-related purposes, unless we expressly authorize another use in writing.

2. No Brokerage, Agency, or Professional Advice

The content on the Site is provided for general informational purposes only. Nothing on the Site is intended to:

  • create a brokerage, agency, fiduciary, client, or professional relationship between you and Trimark Realty;
  • constitute legal, tax, financial, lending, appraisal, inspection, insurance, or other professional advice;
  • serve as a substitute for professional advice tailored to your situation; or
  • guarantee any specific real estate, financing, valuation, tax, legal, investment, or transaction outcome.

Any real estate services, representation, or agency relationship with Trimark Realty will be governed by a separate written agreement signed by you and an authorized real estate professional, together with any disclosures required by applicable law.

You should consult with an attorney, accountant, lender, inspector, appraiser, insurance professional, or other qualified professional before making financial, legal, tax, or real estate decisions.

3. Accounts, Saved Searches, Saved Listings, and Listing Alerts

The Site may allow you to create an account, save properties, create saved searches, receive listing alerts, request property information, request showings, submit inquiries, or use other personalized home search features.

When you create an account or use these features, you agree to:

  • provide accurate, current, and complete information;
  • keep your login credentials confidential;
  • be responsible for all activity that occurs under your account;
  • promptly update your account information if it changes; and
  • notify us promptly if you believe your account has been accessed without authorization.

We may suspend, restrict, or terminate your account or access to any feature if we believe you have violated these Terms, misused the Site, provided inaccurate information, created a security risk, violated applicable law, violated fair housing laws, violated MLS or data provider rules, or engaged in activity that may harm Trimark Realty, other users, service providers, data providers, MLSs, listing brokers, or third parties.

Listing alerts, saved searches, saved listings, property recommendations, email alerts, text alerts, and similar features are provided for convenience only. We do not guarantee that alerts will be complete, accurate, timely, uninterrupted, or error-free. Property availability, price, status, open house information, and other listing details may change at any time, including before or after an alert is sent.

4. Home Search, Property Listings, MLS Data, and Web API Feeds

Our Site operates a Trimark Realty home search experience that displays real estate listing and property information obtained through authorized MLS, Web API, and related data feeds, including data from CRMLS, Trestle, MLSs, listing brokers, public records, and other real estate data providers.

Property listings and related data displayed on the Site may include listings from other real estate brokerages and listing agents. Listing content may include property addresses, listing status, price information, property characteristics, photographs, virtual tours, open house information, listing remarks, public record data, market information, and other property-related information.

While property information is believed to be reliable, it is not guaranteed. Property information, listing availability, pricing, status, square footage, lot size, school information, tax information, HOA information, features, photographs, and other details may be inaccurate, incomplete, delayed, changed, withdrawn, or not updated in real time.

You are responsible for independently verifying all property information before making any decision. You should verify information directly with the listing agent, listing broker, seller, landlord, property manager, public records, MLS, inspectors, appraisers, lenders, title or escrow professionals, and other appropriate sources.

4.1 No Guarantee of Availability or Real-Time Accuracy

We do not guarantee that:

  • any property displayed on the Site is still available;
  • any listing price, status, open house information, or property detail is current or accurate;
  • all available properties in a market are displayed on the Site;
  • the Site will show every price change, status change, open house, or listing update immediately;
  • property valuation estimates, market information, school information, neighborhood information, or search results will reflect actual market value or actual property conditions; or
  • listing alerts or saved search results will capture every property matching your criteria.

4.2 Listing Data Restrictions

MLS, Web API, listing, property, photograph, public record, and related real estate data displayed on the Site are subject to MLS rules, data license agreements, listing broker requirements, copyright restrictions, database rights, contractual restrictions, and other third-party rights.

You may use listing data from the Site only for your personal, non-commercial use in connection with evaluating real estate. Unless expressly authorized by us in writing, you agree not to:

  • copy, scrape, crawl, harvest, download, extract, cache, index, store, or collect listing data, photographs, property data, search results, or other Site content;
  • use bots, spiders, scripts, browser automation, data-mining tools, scraping tools, AI agents, crawlers, or similar technologies to access or collect Site content or listing data;
  • redistribute, resell, sublicense, publish, display, transmit, or commercially exploit listing data, property information, photographs, or other Site content;
  • create or maintain a database of listings, property records, photographs, contact information, search results, or market data using information obtained from the Site;
  • use Site content or listing data to develop, train, improve, test, validate, or operate artificial intelligence models, machine learning systems, valuation tools, lead-generation tools, competing websites, commercial databases, or commercial data products;
  • remove, obscure, or alter copyright notices, attribution, listing broker information, MLS notices, disclaimers, watermarks, or other proprietary notices;
  • circumvent access controls, rate limits, security measures, authentication systems, data protections, or usage restrictions;
  • reverse engineer, probe, scan, test, or attempt to access any non-public API, feed, database, server, or system used by the Site;
  • use listing data for spam, unsolicited marketing, discriminatory activity, unlawful solicitation, or any purpose prohibited by law; or
  • use the Site or listing data in a manner that violates MLS rules, data provider rules, listing broker rights, intellectual property rights, contractual restrictions, or applicable law.

5. Website Design, Layout, Trade Dress, and Copying Restrictions

The overall design, layout, appearance, structure, visual arrangement, user interface, search experience, page flow, branding, graphics, icons, text, content selection, content coordination, and arrangement of the Site are valuable intellectual property of Trimark Realty and/or its licensors.

Except as expressly allowed by these Terms or by our prior written permission, you may not copy, imitate, reproduce, modify, publish, display, distribute, transmit, sell, license, create derivative works from, or otherwise exploit any protected portion of the Site, including its design, layout, page structure, user interface, search experience, branding, graphics, code, text, images, photographs, listing presentation, or arrangement of content.

You also agree not to use the Site or its content to create, operate, improve, or promote a competing real estate website, property search platform, lead-generation service, brokerage website, advertising product, data product, or other commercial service without our prior written permission.

6. Equal Housing Opportunity

Trimark Realty is committed to the principles of the Fair Housing Act and all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, source of income, marital status, age, ancestry, citizenship, immigration status, military or veteran status, or any other protected class under applicable law.

You agree not to use the Site to submit, post, transmit, request, or facilitate any discriminatory housing preference, limitation, statement, advertisement, inquiry, or conduct prohibited by applicable fair housing laws.

7. Communications, Electronic Notices, Email, Phone, and Text Messages

By using the Site, creating an account, submitting a form, requesting information, signing up for listing alerts, clicking an advertisement, contacting us, or otherwise providing your contact information, you agree that we may communicate with you electronically, including by email, phone, text message, account notices, Site notifications, or other electronic means, where permitted by law.

Communications may include:

  • responses to your inquiries;
  • account-related messages;
  • saved search and listing alert notifications;
  • property updates, showing confirmations, and service-related notices;
  • administrative, legal, or security notices;
  • market updates, newsletters, or marketing messages, where permitted by law.

You may unsubscribe from marketing emails by using the “unsubscribe” link in our emails or by contacting us. You may also be able to manage listing alert preferences through your account.

If you opt in to receive text messages, message and data rates may apply. You may opt out of text messages by following the instructions provided in the message or by contacting us. Consent to receive marketing text messages is not required as a condition of purchasing any property, goods, or services.

Even if you opt out of marketing communications, we may still send you non-marketing messages relating to your account, property alerts you requested, transactions, service requests, legal notices, security notices, or other ongoing services.

8. User Submissions

You may submit information to us through the Site, including contact forms, property inquiries, valuation requests, consultation requests, account information, saved search criteria, messages, feedback, reviews, testimonials, copyright notices, DMCA notices, intellectual property notices, or other materials (“User Submissions”).

You represent and warrant that your User Submissions are accurate to the best of your knowledge and that you have the right to provide them to us.

You agree not to submit any User Submission that:

  • is false, misleading, fraudulent, defamatory, obscene, abusive, harassing, discriminatory, or unlawful;
  • violates fair housing laws or encourages discriminatory housing practices;
  • violates another person’s privacy, publicity, intellectual property, contractual, or other rights;
  • contains viruses, malware, tracking code, or other harmful technology;
  • contains confidential information that you are not authorized to share; or
  • violates these Terms or applicable law.

By submitting User Submissions, you grant us the right to use, store, reproduce, transmit, disclose, and process those submissions as reasonably necessary to operate the Site, provide services, respond to your requests, communicate with you, maintain records, investigate misuse, enforce these Terms, comply with law, and as otherwise described in our Privacy Policy.

9. User Conduct

You agree not to use the Site in any way that:

  • violates any applicable federal, state, or local law or regulation;
  • violates these Terms, our Privacy Policy, MLS rules, data provider rules, advertising platform rules, or third-party rights;
  • infringes or misappropriates the rights of others, including privacy, publicity, contract, copyright, trademark, trade secret, database, and other intellectual property or proprietary rights;
  • is unlawful, fraudulent, deceptive, harmful, threatening, abusive, harassing, defamatory, discriminatory, obscene, or otherwise objectionable;
  • attempts to gain unauthorized access to any portion of the Site, accounts, servers, databases, systems, APIs, data feeds, or networks;
  • uses automated means to access, scrape, crawl, monitor, copy, extract, harvest, or collect information from the Site;
  • interferes with or disrupts the operation, security, availability, or performance of the Site or related systems;
  • introduces viruses, malware, malicious code, tracking code, or other harmful technology;
  • impersonates any person or entity or misrepresents your identity, affiliation, authorization, or intent;
  • uses the Site to send spam, unsolicited communications, or unlawful marketing;
  • uses the Site or listing data to violate fair housing laws or encourage discriminatory housing practices;
  • attempts to bypass restrictions, rate limits, access controls, authentication systems, security features, or data protections;
  • uses the Site, listing data, property information, or other content to train, improve, test, or operate artificial intelligence models, machine learning systems, or commercial data products without written permission; or
  • uses the Site in a manner that could damage, disable, overburden, impair, or compromise our systems or those of our service providers.

10. Intellectual Property

Unless otherwise indicated, all content on the Site, including text, graphics, logos, icons, images, photographs, videos, design, layout, page structure, software, code, search functionality, user interface, selection and arrangement of content, and overall look and feel (collectively, the “Content”), is owned by Trimark Realty, our licensors, data providers, service providers, listing brokers, MLSs, photographers, or other third parties and is protected by copyright, trademark, trade dress, trade secret, database, contract, and other intellectual property and proprietary rights laws.

You may view, download, and print limited portions of Content for your personal, non-commercial real estate use only, provided that you:

  • do not remove any copyright, trademark, MLS, listing broker, attribution, watermark, disclaimer, or other proprietary notices;
  • do not modify the Content;
  • do not copy, reproduce, distribute, publish, display, transmit, sell, license, create derivative works from, or otherwise exploit the Content for any commercial purpose without our prior written consent; and
  • comply with all applicable MLS, data provider, listing broker, photographer, and third-party restrictions.

All trademarks, service marks, trade names, and logos displayed on the Site are the property of their respective owners. Nothing in these Terms grants you any license or right to use any trademark, service mark, trade name, logo, listing data, photograph, database, software, code, design, layout, user interface, or other intellectual property without the prior written permission of the applicable owner.

11. Copyright and DMCA Policy

We respect intellectual property rights and expect users of the Site to do the same.

If you believe that material available on the Site infringes your copyright, you may submit a notice to us as described in our Copyright & DMCA Policy.

We may remove or disable access to allegedly infringing material, restrict access, suspend accounts, or take other action when appropriate. Where applicable, we may terminate or restrict access for users who repeatedly infringe copyrights or other intellectual property rights.

Submitting a false or misleading copyright, DMCA, trademark, or intellectual property notice may result in liability under applicable law.

12. Third-Party Links, Tools, Data, Analytics, and Advertising Services

The Site may contain links, integrations, embedded content, widgets, calculators, maps, property data, school or neighborhood information, mortgage resources, advertisements, analytics tools, social media features, or other tools or services provided by third parties. These may include, without limitation:

  • mortgage calculators, lender websites, affordability tools, and financing resources;
  • school, neighborhood, demographic, mapping, location, or community information resources;
  • MLS, listing, property data, public record, and real estate data providers;
  • CRMLS, Trestle, and related real estate data-feed or technology providers;
  • Google services, including Google Analytics, Google Ads, Google Tag Manager, conversion tracking, remarketing, audience, and advertising measurement tools;
  • social media platforms;
  • analytics, advertising, email, CRM, communication, hosting, security, or support providers; and
  • third-party real estate portals or property information websites.

Third-party links, tools, data, analytics, advertising services, and integrations are provided for your convenience only. We do not control and are not responsible for the content, accuracy, availability, privacy practices, security, terms, policies, or operation of any third-party websites, tools, data, or services.

Your use of third-party websites, tools, data, analytics services, advertising services, or integrations is at your own risk and may be subject to the terms and privacy policies of those third parties.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, disclose, and safeguard information, including information related to accounts, saved searches, listing alerts, Google Analytics, Google Ads, conversion tracking, remarketing, advertising, cookies, and communications.

By using the Site, you acknowledge that you have reviewed our Privacy Policy.

14. Disclaimer of Warranties

YOUR USE OF THE SITE, HOME SEARCH FEATURES, ACCOUNT FEATURES, LISTING ALERTS, PROPERTY DATA, ADVERTISEMENTS, THIRD-PARTY TOOLS, AND ALL CONTENT IS AT YOUR SOLE RISK. THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE FULLEST EXTENT PERMITTED BY LAW, TRIMARK REALTY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • the Site or any feature will be uninterrupted, error-free, secure, or available at any particular time or location;
  • any defects or errors will be corrected;
  • the Site will be free of viruses, malware, or other harmful components;
  • property listings, listing alerts, saved searches, market data, valuation information, school information, neighborhood information, or other content will be accurate, complete, current, or reliable;
  • any property displayed on the Site will be available, suitable, or meet your needs;
  • any listing alert, saved search result, email, text message, or notification will be delivered, delivered on time, or include all matching properties;
  • advertising, analytics, conversion tracking, remarketing, or third-party tools will be error-free, uninterrupted, or accurate; or
  • the Site will meet your expectations or produce any particular real estate, financial, legal, tax, investment, marketing, or business result.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRIMARK REALTY OR ITS OWNERS, BROKERS, AGENTS, AFFILIATES, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, DATA PROVIDERS, MLS PROVIDERS, LICENSORS, ADVERTISING PROVIDERS, ANALYTICS PROVIDERS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF BUSINESS OPPORTUNITY, LOSS OF USE, PROPERTY-RELATED LOSSES, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, HOME SEARCH FEATURES, LISTING ALERTS, PROPERTY DATA, ADVERTISEMENTS, THIRD-PARTY TOOLS, OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, TRIMARK REALTY WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM:

  • inaccurate, incomplete, delayed, changed, or unavailable property information;
  • errors, interruptions, delays, or omissions in listing alerts or saved search results;
  • your reliance on any property listing, market information, valuation information, school information, neighborhood information, advertisement, or other content;
  • unauthorized access to or use of your account, unless caused by our gross negligence or willful misconduct;
  • third-party websites, services, data, advertisements, analytics tools, maps, calculators, or content;
  • copying, scraping, misuse, unauthorized access, or unlawful conduct by third parties; or
  • events beyond our reasonable control.

TO THE EXTENT ANY LIABILITY IS FOUND DESPITE THE FOREGOING, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, CONTENT, PROPERTY DATA, ADVERTISEMENTS, THIRD-PARTY TOOLS, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO USE THE SITE, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Trimark Realty and its owners, brokers, agents, affiliates, employees, contractors, service providers, data providers, MLS providers, licensors, advertising providers, analytics providers, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

  • your access to or use of the Site;
  • your account, saved searches, saved listings, listing alerts, User Submissions, or communications;
  • your violation of these Terms;
  • your misuse of property listings, MLS data, Web API data, photographs, Content, design, layout, code, or other information obtained from the Site;
  • your copying, scraping, crawling, harvesting, extracting, storing, redistributing, reselling, or commercial use of Site content or listing data;
  • your violation of applicable law, fair housing laws, MLS rules, data provider rules, advertising platform rules, or third-party rights;
  • your violation of any rights of another person or entity; or
  • your fraud, misrepresentation, negligence, or willful misconduct.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

17. Suspension, Termination, and Site Changes

We may update, modify, suspend, restrict, or discontinue all or any part of the Site, including home search features, account features, saved searches, saved listings, listing alerts, property data, advertisements, analytics tools, or other services, at any time without notice.

We may suspend, restrict, or terminate your access to the Site or your account at any time if we believe you have violated these Terms, created risk or possible legal exposure, misused listing data, copied or scraped Site content, attempted unauthorized access, violated MLS or data provider rules, violated fair housing laws, or used the Site in a manner that may harm Trimark Realty, other users, service providers, data providers, MLSs, listing brokers, advertising providers, analytics providers, or third parties.

Upon termination, the rights granted to you under these Terms will stop immediately. Sections that by their nature should survive termination will survive, including provisions regarding intellectual property, website design and layout restrictions, listing data restrictions, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Site, services, technology, data sources, MLS or data provider requirements, Google services, advertising practices, legal requirements, or business practices. When we do, we will revise the “Last updated” date at the top of this page.

Your continued use of the Site after updated Terms are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.

19. Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, property data, listing alerts, account features, advertisements, third-party tools, or your use of the Site shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of such courts.

Nothing in these Terms prevents us from seeking injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property, confidential information, Site security, listing data, MLS data, data-feed rights, website design, layout, trade dress, code, or other proprietary rights.

20. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, Copyright & DMCA Policy, and any other policies or terms referenced herein, constitute the entire agreement between you and Trimark Realty regarding your use of the Site.

Any separate written agreement for real estate brokerage services, buyer representation, seller representation, leasing services, property management, referral services, advertising services, or other professional services will govern the specific services covered by that agreement. If there is a conflict between these Terms and a separate written agreement signed by you and Trimark Realty, the separate written agreement will control only as to the specific services covered by that agreement.
